Lessons From the Front: Managing the Program Manager

This Panel will review the basic procedures and players in insurance insolvency, examine new developments/ trends in insurance insolvency and shine a spotlight on specific issues encountered when other insurers are creditors or debtors of the insolvent insurer.   It will also take a very quick review of mechanisms that can change the corporate structure of an insurer and therefore have an impact on future insolvencies.

Florida Bad Faith Claims: Best Practices in Claims Handling
The session will cover the dynamics of claims-handling in Florida, benchmarks of good faith claims-handling and avoiding bad faith claims, and preferred approaches in the following scenarios: (1) denial of coverage; (2) defense under a reservation of rights (ROR), (3) policyholder rejection of a defense offered under ROR; (3) special issues where there are multiple claimants or multiple insureds, (5) primary v. excess bad faith claims, (6) eroding policies, (7) time-limited settlement demands; (8) the insured’s duty to cooperate and insurer’s duty to foster cooperation, and (9) consent judgment agreements between the claimant and the insured.

The Future of Claims

What do the insurance claims of the future look like?  Will the job of the claims professional be different?  The session will take a look at the emerging technological trends in the industry, as well as practical use applications.

The Latest on Insurance Business Transfer Statutes - Rhode Island, Connecticut, Oklahoma
The panelists will discuss the various aspects and considerations of the insurance business transfer provisions in Connecticut’s and Rhode Island’s insurance regulations and proposed under Oklahoma insurance law as well as the well-established European legal framework.  The varying perspectives of an international company, a large insurer, former regulators, and attorneys will provide the audience with some insights as to how a company can use these tools to achieve finality, interesting information on the background of the statutes, and examine the questions surrounding why there hasn’t been a transaction as of yet.
