It will als o take a very quick review of mechanisms that can change the corporate stru cture of an insurer and therefore have an impact on future insolvencies.

: Best Practices in Claims Handling
The session will cover the dynamics of claims-handling
in Florida, benchmarks of good faith claims-handling and avoiding bad faith
claims, and preferred approaches in the following scenarios: (1) denial of
coverage; (2) defense under a reservation of rights (ROR), (3) policyholde
r rejection of a defense offered under ROR; (3) special issues where there
are multiple claimants or multiple insureds, (5) primary v. excess bad fait
h claims, (6) eroding policies, (7) time-limited settlement demands; (8) th
e insured’s duty to cooperate and insurer’s duty to foster coop
eration, and (9) consent judgment agreements between the claimant and the i
nsured.
