The seminar will provide information on:
- Recent Developments in US Liabi
lity Insurance Law: The Restatement of the Law, Liability Insuranc
e. This panel discussion will provide the latest information on the controv
ersial publication by the American Law Institute in its Restatement of the
Law of Liability Insurance. This panel will discuss the central Provisions
of the Restatement, Reactions by various state Legislatures, and the impact
that the Restatement has had and may have in future disputes involving the
duty to defend, the duty to settle and the expanded scope of bad faith lia
bility for insurers in the United States.
- Updates in US Arbitration Practice
: This panel will address recent trends impacting insurance and re
insurance arbitration’s in the United States, including recent decisions on
evident partiality and legislative actions addressing these decisions. We
will also present a panel discussion on the differences between London arbi
trations and U.S. arbitrations. Finally, we will discuss AIRROC’s Dispute R
esolution and Mediation Procedures (“DRP” and “MP”). The DRP and MP provide
vehicles for parties with an efficient mechanism to resolve disputes. We w
ill provide a discussion of the procedures and the benefits of pursuing the
se dispute resolution vehicles.
- US Wild
fire Exposures: This panel will look at the liability and insuranc
e issues associated with the devastating losses related to the numerous rec
ent California wildfires. Topics will include potential sources of liabilit
y, first party and commercial property insurance and reinsurance issues, as
well as the potential impact of the PG&E bankruptcy on these matters.<
